This article outlines the recent amendments to the Aliens and Immigration Law in Cyprus (the 鈥樷楲aw鈥欌�), and specifically  the sections relating to the 鈥樷橞lue Card鈥欌�, which are effective as of 1 August 2024. These amendments have been introduced to harmonize Cyprus鈥�  national legislation with  European Directive 2021/1883,  concerning the employment of third country nationals and promoting  professional mobility for "highly skilled" workers within European borders. The authors  provide a detailed assessment of the amended provisions in the Law and offer their opinion on the overall legislative framework. 

Reform of the legislative framework relevant to the Blue Card Euro-Employment

As of 1 August 2024, the new legislative framework, which provides the possibility of employing third-country nationals in European territory, came into force in Cyprus. It  aims to simplify the process of their employment and to attract, as well as to promote, such employment in our country. The legislative reform of the Aliens and Immigration Law was promoted with the aim of harmonising  national legislation with  European Directive 2021/1883, which forms the basis for  promoting  broad professional mobility for "highly skilled" workers within European borders in the context of the EU's race, on the global stage, to attract highly skilled talent, compared to other destinations.

The Blue Card is valid to 25 EU countries, excluding Denmark and Ireland, and  allows entry, re-entry, and residence in the  country issuing the  card. One key innovation of this reform is the possibility   for Blue Card holders to move visa-free to other EU countries for a maximum of 3 months per six-month period to pursue  their professional activities. Furthermore, after one year's stay in an EU country, Blue Card holders can live and work in another member state and apply for a new Blue Card  issued by that state. The validity of the Blue Card is now extended to at least 24 months (with the right to renew), whereas previously,   it was limited to 12 months.The definition of highly skilled employment is broad and, as harmonised and incorporated into Cypriot legislation, covers: (a) the employment of persons with qualifications certified by a higher education degree, and (b) skills/abilities certified by professional experience equivalent to a higher education degree for professionals in the information, communications and technology industry.Blue card holders have the right to work in highly skilled occupations with competitive salaries, compared to those of EU nationals in Cyprus.  The salary threshold for applicants is set at 1 to 1.6 times  the average gross minimum national salary, which currently ranges  from 鈧�20,000 - 鈧�32,000 annually. Before the reform,  the salary had to be  at least 1.5 times the average gross annual salary in  the Republic and no less than the relevant national minimum salary.As before the amendment, Blue Card holders are entitled to  the same working conditions, educational opportunities, social security benefits, and access to services as  citizens of their host country. It is important to note  that  the reforms now allow  for the immediate relocation of the card holder's family, as  residence permits for family members are issued and communicated at simultaneously  with the Blue Card,  ensuring family  unification.The application for admission must be made through a specific employer, as is the case for other application categories. There must be an employment contract for at least six months. The application must be accompanied by documents proving  the applicant鈥檚 professional qualifications, a valid travel document, proof of insurance coverage, and  a temporary address of residence in the Republic. The reform did not eliminate   the obligation (where applicable) to present an entry permit (''visa'') or related application, or proof of a valid residence/long-term residence permit for the entry. The timeframe for providing a response to the application remains  90 days.The period of temporary unemployment for Blue Card holders may last up  to 3 months if  the Blue Card has a been held for  less than 2 years. If the holder has the card for more than  2 years, the  unemployment period may last  up to 6 months before the Blue Card is canceled.Regarding the acquisition of long-term resident status, Blue Card holders can still accumulate periods of residence in different Member States  to fulfill the length of stay requirement and submit an application, as was the case before the amendments. Holding  a Blue Card can be a valuable  tool for simplifying  the process of obtaining European citizenship.Overall, the reform brings changes to the pre-existing legislation, and  the possibility of visa-free movement of third-country nationals within European borders is undeniably attractive. However, although the amended framework has not yet been implemented to draw  safe conclusions, based on the letter of the law, it seems that there is no scope for oversimplification of the relevant legislative framework.
