Summary: According to the new amendments, the employment relations are now formalized through electronic agreements signed with enhanced electronic signatures, eliminating the need for paper contracts. Resignation notices, leave requests, and other employment-related documents can now be submitted through the electronic system as well. The requirement for a labor book when entering into new agreements is eliminated, with work activity now recorded electronically.
Commentary: The following significant amendments have been made to the Labor Code of the Republic of Azerbaijan (hereinafter will be referred to as the 鈥淐ode鈥�) by the Law dated June 28, 2024 (hereinafter will be referred to as the 鈥淟aw鈥�):
1. Conclusion of the employment agreement in electronic form
Based on the amendments to the Code, employment relations are officially established when an employment agreement (except for cases where the Code specifically requires an employment agreement to be concluded on paper) is executed as an electronic document within the electronic information system of the Ministry of Labor and Social Protection of the Population of the Republic of Azerbaijan (hereinafter will be referred to as the 鈥渆lectronic system鈥�).
Before the amendments, conclusion, amendment, or termination of an employment agreement took effect only after the employer鈥檚 notice, submitted via enhanced electronic signature, was registered in the electronic system and a confirmation of the notice was electronically the employer.
In accordance with the amendments, conclusion and amendment will take effect after being executed through signing by means of an enhanced electronic signature by both parties.
Accordingly, employees must have an enhanced electronic signature (e.g. Asan Signature or SIMA signature) to fulfill the carry out the mentioned actions.
The requirement to conclude employment agreement on paper will not apply to employees in the mentioned category.
2. Submission of other documents related to employment relations in electronic form.
According to the amendments to the Code, an employee鈥檚 resignation notice can also be submitted to the employer through the electronic system.
Additionally, the employee鈥檚 leave request, as well as the employer鈥檚 orders and directives on other matters, certificates, references, and other documents, can also be submitted through the electronic system.
3. Requirements regarding the labor book.
According to the amendments, employees are no longer required to provide a labor book when entering into a new employment agreement, and the requirement to record information related to an employee鈥檚 work activity in the labor book is removed. Such information will now be recorded only through the electronic system (with the exception of employees working in some state bodies who are required to conclude an employment agreement on paper).
At the same time, work experience of employees whose employment agreements were terminated before July 1, 2014 (i.e. before launch of the electronic system for the registration of employment agreements), will be determined based on their labor book.
4. Termination of a fixed-term employment agreement
According to the amendments, if neither party provides written notice (either on paper or through the electronic system) of the termination of the fixed-term employment agreement at least 1 (one) week before its expiration, the agreement shall be automatically extended for the duration specified in the agreement.
Before the amendments, however, the notice could be given within 1 (one) week after the expiration of the fixed-term employment agreement.
Potential impact of the Law: Electronic agreements are expected to contribute to streamlining the process, allowing for quicker drafting and signing. Also, the fact that the application for the termination of the employment agreement by the employee could be submitted to the employer through the electronic system will allow to accurately determine the date of submission of such application which may occasionally become a point of dispute.
Many employees may view electronic agreements as more modern and convenient, but there could be resistance from those who are less comfortable with digital processes. Providing adequate support and clear communication about the process can help in gaining acceptance among the employees.
Furthermore, the reduction in paper usage contributes to environmental sustainability efforts by minimizing waste associated with traditional paper-based processes.
The Law has entered into force on August 12, 2024.
